Terms & Conditions

Effective [EFFECTIVE DATE]

Draft — not yet reviewed by counsel.

A plain-language summary of the rules is in the FAQ. If the FAQ and these Terms ever disagree, these Terms apply.

1. Who we are and these terms

Flurri.us (the "Service") is operated by [OPERATOR NAME] ("we", "us"). These Terms & Conditions ("Terms") are an agreement between you and us. By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

The Service is in beta. Features, prices, and rules may change as we develop it. We'll describe material changes on this page and update the effective date; continuing to use the Service after a change means you accept the updated Terms.

2. Eligibility and accounts

You must be at least 16 years old to use the Service. By joining, you confirm that you are.

You can register as a reader or as a writer. A writer registration also creates a linked reader account with the same email and password; the two are separate accounts. Each email address can be used for one account of each type.

You're responsible for your account, for keeping your password secure, and for everything that happens under your account. Give us accurate information and keep your email address current.

Writer and reader accounts are kept apart on purpose. Using one of your accounts to promote, review, like, unlock, tip, or otherwise benefit the other — or coordinating with others to do so — is prohibited and may result in a permanent ban.

3. Your content

You keep ownership of the books, chapters, images, comments, and other content you post ("Your Content").

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute Your Content as needed to operate, provide, and promote the Service — including showing free previews and redacting the remainder until a reader unlocks it. This licence ends when you delete Your Content, except for copies retained in backups or as required by law, and for content a reader has already unlocked, which remains available to that reader while the chapter exists.

You promise you have the rights to everything you post and that it doesn't infringe anyone else's rights or break the law.

Writers may edit or delete their chapters at any time, except while a chapter is under moderation review. Unlocks and tips for deleted or edited chapters are not refunded.

4. Content rules

Don't post content that is illegal, infringes intellectual property, harasses or threatens others, reveals someone's private information, sexualises minors, promotes violence or self-harm, is spam, or contains malware.

Don't attempt to manipulate likes, unlocks, rankings, or payouts; don't create accounts to evade limits or bans; and don't interfere with the Service, scrape it, or access it by automated means without our permission.

5. Comments

Readers may comment only on chapters they have unlocked. Writers may turn comments off on any of their chapters or across all of their books, and may block individual readers from commenting on their books. While comments are off or a reader is blocked, the affected comments are hidden, not deleted, and reappear if the writer reverses the setting.

We may remove comments that break these Terms.

6. Moderation, suspension and bans

Readers who have unlocked a chapter may report it. A chapter reported by more than half of the readers who unlocked it, at least 24 hours after publication, is automatically hidden pending review. Our administrators may also review, hide, restore, or delete any content at their discretion.

We may suspend any account that breaks these Terms or puts the Service or other users at risk. Permanent bans are issued only by the Service owner, apply to an individual account, and may be lifted by the Service owner. A suspended or banned account can't sign in.

While a writer account is banned, its chapters are hidden from readers and its earnings are held: nothing is paid out, and nothing is deleted. If the ban is lifted, the chapters reappear and held earnings become available again. Earnings obtained by breaking these Terms may still be withheld as described in section 8.

7. Flurries (virtual currency)

Flurries are a virtual currency used only within the Service to unlock and tip chapters. One Flurry corresponds to US $1 of value for pricing purposes. Flurries are a licence to use features of the Service, not property, money, or a deposit; they have no cash value for readers and cannot be withdrawn, transferred between users, or exchanged for money, except as described for writer earnings in section 8.

Free Flurries are granted weekly to readers, carry over in limited amounts for one week, and then expire. Golden Flurries are purchased, or earned through features such as the weekly likes reward, and do not expire while your account remains active.

Golden Flurries are sold in packs through our payment processor, Stripe. Prices include payment processing and are shown before you pay. You may purchase up to 20 Golden Flurries per week. Purchases are final and non-refundable except where required by law or where we decide otherwise.

If a purchase is refunded, reversed, or disputed, we remove the corresponding Golden Flurries from your balance. Unlocks and tips are final once made.

We may change prices, allowances, and how Flurries work during the beta; changes do not affect Golden Flurries you have already purchased, except as described above.

8. Writer earnings and payouts

When a reader unlocks or tips one of your chapters, the full amount is credited to your writer account. During the beta, only earnings paid by readers in Golden Flurries are cashable; earnings paid in free Flurries are shown separately and cannot be withdrawn.

You must have a payout method on file to publish. Payouts are made in whole Flurries, with a minimum of 1 Flurry (US $1), and a platform fee of 8% is deducted from each payout. During the beta, payouts are simulated and no money is transferred until our payment-provider integration launches; we will update these Terms before real payouts begin.

You are responsible for any taxes on your earnings. We may require identity and tax information before paying you, may withhold payment for earnings we reasonably believe were obtained by breaking these Terms, and may adjust balances to correct errors or reflect refunds and disputes.

9. Your email and privacy

We use your information to run the Service. We do not sell your personal information or show third-party advertising.

Readers may choose, each time they like or comment, to share their account email with that chapter's writer. A writer can see and download the current email addresses of readers who have shared with them. You can remove yourself from a writer's list at any time from your profile, but a writer may already have saved your address, and how they use it is between you and that writer. Writers who use shared emails must comply with applicable law, including anti-spam and privacy laws.

10. Beta, disclaimers and liability

The Service is a beta and is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Features may change or be removed, and data may be lost.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50.

You agree to indemnify us against claims arising from Your Content or your breach of these Terms.

11. Ending your use

You may stop using the Service at any time. We may suspend or end your access as described in section 6, or discontinue the Service with reasonable notice where practical. Sections that by their nature should survive (including 3, 7, 8, 10 and 12) survive termination.

12. Governing law

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Ohio, and you and we consent to their jurisdiction.
